A group of residents submitted the complaint on Thursday (Mar 12) at the Phuket Damrongtham Center (provincial ombudsman’s centre), saying the issue arose following the sale of land that they claim has long served as a shared easement and public utility area within the project.
According to residents, the roads, walkways and common areas in question have been used by the public since the project was established in 1989.
They explained that after the land changed ownership, a survey of the area was conducted based on the land title deed, raising fears that the new owner may block the internal access routes used by residents and others travelling through the project.
Residents warned that any closure of the access points would create significant hardship for people living in the area and those who regularly pass through it. Some also expressed concern that access to the area could potentially be restricted or subject to fees in the future.
The residents insist that the land was originally designated as a shared public utility area of the project, including roads and pedestrian walkways that have been openly used by the public for decades.
They argued that anyone who later purchased the land from the original project should recognise the rights and responsibilities tied to its long-standing use, and should not restrict access or impose charges for using the routes.
Affected residents said the dispute impacts more than 100 households in the surrounding area. They added that they are prepared to unite to pursue justice and take legal action if necessary.
Officials at the Phuket Damrongtham Center confirmed that the complaint has been formally accepted for consideration.
A preliminary review found that the land involved is registered under the Poonphol Nice Plaza project and had previously been used as a public space within the development. However, after the change of ownership, some access points have reportedly already been blocked.
The centre said it will now investigate the matter and coordinate with relevant government agencies to determine the facts and seek a solution that ensures fairness for all parties involved.
