Officials halt unauthorised excavation in Baan Phru Champa

PHUKET: The Thepkrasattri Tambon Administrative Organisation (OrBorTor) has ordered an immediate halt to excavation work in Baan Phru Champa after officials found the operation was being carried out without the required permits.

The inspection was conducted on Monday (July 6) after the OrBorTor received reports of ongoing excavation in Soi Hin Lat, Moo 3, Baan Phru Champa.

OrBorTor Chief Sittichai Chanthawat assigned planning and construction officials, led by Ariya Khwanlek, to inspect the site.

Officials found that Thai Naprasert Mining Co Ltd had excavated three pits: Pit 1: 100 x 200 metres, about four metres deep; Pit 2: 150 x 300m, about four metres deep; and Pit 3: 30 x 200m, about four metres deep.

The OrBorTor said the excavation had not been authorised under the Land Excavation and Filling Act B.E. 2543 (2000). Officials erected a suspension notice at the site and issued an order requiring all excavation work to stop immediately until the operation complies with the law.

Mr Sittichai said the company had told officials the pits were intended to be used as small reservoirs to supply water to local residents and businesses.

“They are not permitted to clear any land or dig any part of the site without approval,” he said. “The order to halt excavation remains in effect.”

The OrBorTor also advised the company to verify land boundaries and conduct a proper land survey before applying for any future permits in order to avoid disputes and minimise impacts on nearby communities.

Under the Land Excavation and Filling Act, excavation deeper than three metres, excavation with a surface area exceeding 10,000 square metres, or work that could pose a risk to people or property requires prior notification or approval from local authorities.

Violations are punishable by up to one year in prison, a fine of up to B50,000, or both. Local authorities also have the power to order illegal activities to be suspended or corrected.

A follow-up inspection involving the Phuket Land Office, Thalang Police, the Phuket office of the Ministry of Natural Resources and Environment (MNRE) and Thepkrasattri OrBorTor is scheduled for July 20.
