MaAnn sentenced to 2 years’ jail for corruption

PHUKET: MaAnn Samran, the former Chief of the Cherng Talay Tambon Administration Organisation (OrBorTor), has been sentenced to two years’ imprisonment for corruption without the option of parole.

The National Anti-Corruption Commission (NACC) announced the sentencing last Friday, reports Isra News.

MaAnn was found guilty of improperly selecting and appointing administrators. The Criminal Court for Corruption and Misconduct, Region 8, sentenced him to two years in prison with no parole, said the report.

The court ruled that MaAnn had unlawfully selected OrBorTor employees and appointed them to higher-level executive positions.

The Criminal Court for Corruption and Misconduct, Region 8, on May 11 had ruled that MaAnn Samran was guilty of an offense under Section 157 of the Criminal Code and several other anti-corruption laws.

“The defendant’s action is a single act which violates many laws. Punishment is required according to Section 123/1 of the Organic Act on Anti-Corruption  1999.

Section 123/1 states:  Any State official who acts or omits any act in his or her position or duty or unlawfully exercises power in his or her position or duty in order to cause injury to any particular person or acts or omits to act in a dishonest manner, shall be liable to imprisonment for a term of one to 10 years or to a fine of B20,000 to B200,000 or both.

MaAnn was also found guilty of violating Section 157 of the Criminal Code, which states: Whoever, being an official, wrongfully exercises or does not exercise any of his functions to the injury of any person, or dishonestly exercises or omits to exercise any of his functions, shall be punished with imprisonment of one to to 10 years or to a fine of B20,000 to B200,000 or both.

In total, the court sentenced MaAnn to two years in prison.

However, MaAnn has the right to appeal, the NACC noted.

MaAnn has been cited for corruption in yet another investigation by the NACC.

MaAnn, along with three other officials, stand accused by the NACC of providing illegal and forged documents for the construction of the New Nordic Phuket Water World project in Bang Tao.

Charges pending that investigation have yet to be made clear.
