Mr Karadag’s lawyer, Choochart Kanpai, said he planned to petition against the military court’s authority to hear the case that began in Min Buri provincial court, which is not overseen by the military.
Mr Choochart said he has to wait until military prosecutors indict the suspect.
Details of the expected indictment will be revealed to the public and he will then be able to proceed with the planned petition against the military court’s role in hearing the case.
Military prosecutors have not yet indicted Mr Karadag or other key suspects believed to be involved in the bombings in August, including Yusufu Mieraili who allegedly confessed to detonating the Erawan shrine bomb, leaving 20 foreign tourists and Thais killed and 130 injured.
The prosecutors successfully sought permission from the Bangkok Military Court yesterday to further detain both suspects.
The suspects were taken from the temporary prison at the 11th Military Circle in Dusit district of Bangkok to the Bangkok Military Court in Phra Nakhon district for a hearing on the prosecutors’ request for a longer period of detention.
They arrived at the court yesterday morning.
After the court approved the request, they were taken back to the detention facility.
Mr Choochart said the court approved a request to further detain Mr Karadag from today until Nov 24.
He said he had no information about Mr Mieraili who is not his client.
He said the court’s permission for Mr Mieraili to be detained expires three to four days after that of Mr Karadag.
Mr Choochart said he believed military prosecutors were likely to indict the suspects on Nov 24, the last day they are allowed to detain Mr Karadag.
Still, the court was also asking prosecutors to speed up preparing the paperwork for the indictments, he said.
Mr Choochart said he expected the military prosecutors to choose to first indict the suspects only on some serious counts such as murder and the possession of war materials.
Other counts such as illegal entry and document forgery, which in this case involved fake passports, would be left to deal with later, Mr Choochart said.
Mr Karadag and Mr Mieraili were both charged with premeditated murder, causing death and severe injuries with explosive devices, causing damage to the assets of others, possession of explosives without permission, carrying bombs into public places and possession of war materials without permission.
The pair were among 17 people wanted under arrest warrants approved by the Bangkok Military Court over the Erawan shrine and Sathon pier blasts.
Mr Karadag was arrested on Aug 29 at a room in the Pool Anant apartment in Nong Chok district of Bangkok where authorities found and seized a large amount of bomb-making equipment.
