The case revolves around a bitter dispute following the controversial Sydictive New Year Party in Patong at the end of 2012.
The defamation case was filed jointly by Jirat “Champ” Petnunthawong and Sydictive Element Co, of which he is an executive.
During the trial, the plaintiffs said Anandadvip, his sister Sirilada, and two others – Jechiya Apichatmanee and Pen Suksomboonwong – in March 2013 invited the media to cover a press conference at the Crime Suppression Division (CSD).
Anandadvip later gave an interview on the Chao Doo Woody TV show hosted by Wuthithorn and Chalermpol, where he repeated his accusations.
The court found the press conference at the CSD was aimed at damaging Mr Jirat’s reputation.
If there was a contractual violation, Anandadvip could have filed a civil lawsuit and demanded compensation, the court said.
Anandadvip has in fact already lodged a complaint with Prakanong Provincial Court and that case is now going through an appeal process.
The court said that although Wuthithorn and Chalermpol work in the media and have the right of freedom of expression, they must exercise their rights cautiously. As media personalities, they have a social responsibility not to cause damage to others, the court ruled.
All three will appeal and the court released Anandadvip on bail of B300,000 and the other two on bail of B100,000.
Sirinda, Jeniya and Pen were each fined B100,000 and given suspended sentences for their part in the press conference.
