Bangkok restaurant fined for beer displayed in menu

BANGKOK: The authorities in the capital have fired a hefty shot across the bows of restaurants, fining a Japanese eatery a total of B146,000 for including photos of beer bottles with the labels of the brands in their menu.

The target of the fines imposed by the court in a case brought by the Office of the Alcohol Control Committee was Kacha Kacha restaurant in the Asiatique complex, next to the Chaophraya River in Bang Koh Laem.

The ThaiVisa message board reports that the restaurant and its owner, with fines of B230,000 each for contravening Article 32 and Article 43 of the Alcohol Control Act of 2014 and Article 83 of the Criminal Code.

Article 32 of the Alcohol Control Act states, "No person shall advertise or display, directly or indirectly, the name or trademark of an alcoholic beverage in a manner that shows the properties thereof or induces other persons to drink."

Article 43 defines the penalty: "Whoever violates section 32 shall be liable to imprisonment for a term not exceeding one year or a fine not exceeding B500,000 or both.

"In addition … the violator shall be liable to a daily fine not exceeding B50,000 a day through the period of violation or until acting correctly."

Article 83 of the Criminal Code states, "In case of any offence accrued by commission of the person as from two persons upwards, such accomplices deemed to be principals shall be punished as provided by the law for such offence."
